Vor 10 Jahren wurde die Arbeitsmarktpolitik in Deutschland nach der Maxime Fördern und Fordern umgestaltet. Die Untersuchung zeichnet den aktivierenden Wohlfahrtsstaat als zentrale Projektion europäischer Sozialpolitik nach, mit guten Praktiken aus den Niederlanden, Dänemark, Großbritannien und Frankreich als Vorbild. Inzwischen hat sie auch in Deutschland viele Spuren hinterlassen. Der Neuansatz sucht die Neubelebung der Arbeitsgesellschaft, der Sozialpolitik seit jeher diente. Er findet sein Fundament nicht im „Neoliberalismus“, sondern im „Kommunitarismus“. Eigenverantwortung und Sanktionen gehören zu diesem Konzept wie die Bekämpfung von Betrug beim Bezug von Sozialleistungen. Die Sozialverwaltung überwindet ihre angestammt bürokratische Ausrichtung und öffnet sich als case-management der Sozialarbeit. Die Studie zeigt: Der aktivierende Wohlfahrtsstaat verändert den hergebrachten Sozialstaat nicht nur in vielen Details, sondern gründet ihn vor allem auf neue rechtliche Strukturen.

The intellectual fundament of the activating welfare state is not neoliberalism, but communitarianism. Self-reliance and sanctions are elements of this approach as it fights at the same time against social security fraud. A bureaucratic organisation is replaced by case and contract management, to tackle social risks and miseries. The study unveils: the activating welfare state reforms the classical welfare state in its basic legal structure.
