Der Titel dieses Buches erweckt den Eindruck, als ob es sich hier um rechtsvergleichende Arbeiten handele. Aber im Vordergrund steht eher das rein rechtstheoretische Erkenntnisinteresse. Unter diesem Gesichtspunkt lassen sich die hier vorgelegten Arbeiten – sechs rechtsphilosophische und sechs strafrechtliche – in drei Fragenkomplexe einteilen. Im Zentrum des ersten Fragenkomplexes steht entweder der rechtsphilosophische Gedanke von bestimmten Rechtsphilosophen wie Hans Welzel und Arthur Kaufmann oder das Grundprinzip des Strafrechts wie der Grundsatz des Rechtsgüterschutzes oder das Schuldprinzip. An dieser Stelle folgt auch die Analyse der Verantwortungsstruktur der modernen Risikogesellschaft oder die Darstellung der Vergangenheitsbewältigung durch das Strafrecht. Der zweite Fragenkomplex betrifft die Rezeption des deutschen Strafrechts. In diesen Zusammenhang einzuordnen ist auch die Frage nach der Methode des juristischen Denkens in Korea. Schließlich umfasst der dritte Themenkomplex einzelne rechtsdogmatische Probleme wie das Verhältnis von Recht und Moral im koreanischen Strafrecht, das Thema der fehlenden Unrechtseinsicht und das Problem der sog. passiven Euthanasie, welche anhand eines aktuellen Urteils erörtert werden.

From this point of view, the work presented here - 6 legal philosophical and 6 criminal-law - can be divided into three parts. At the center of the first part is the legal philosophical thought of certain legal philosophers, such as Hans Welzel and Arthur Kaufmann, or the basic principle of criminal law, such as the principle of legal interest or the principle of liability. This also includes an analysis of the structure of the responsibility of the modern risk society or the term with past in the criminal law. The second part concerns the historical process of the reception of German criminal law. The question of the method of legal reasoning in Korea should also be included in this context. Finally, the third topic complex deals with dogmatical problems. 1) the relationship between law and morality in Korean criminal law, 2) the topic of the ignorance of law and 3) the problem of passive euthanasia in a recent judgment.
