Die pharmazeutischen, biologischen und chemischen Patente stellen innerhalb des europäischen und deutschen Patentrechts eine Spezialmaterie dar, die spezielle bei anderen Patenttypen nicht relevante Fragen aufwerfen. Gewisse strukturelle Veränderungen, beispielhaft in Verbindung mit Polymorphismus oder Enantiomere, können zu Stoffderivaten führen, die im Stand der Technik zwar enthalten sind und dennoch die Frage aufwerfen, unter welchen Umständen solche Änderungen als neu im Sinne des Patentrechts bezeichnet werden können. Doch selbst wenn ein Stoff dem Stand der Technik entspräche, könnte eine neue medizinische Nutzungsform ein neues Patent rechtfertigen, um so einen Anreiz für medizinische Forschung zu schaffen. Andererseits ist umstritten, wie in diesem Zusammenhang aus bioethischer Sicht mit natürlichem Vorkommen von Substanzen umgegangen werden soll.
Kürzlich ergangene Entscheidungen des Gerichtshofes der EU zu Patenten auf Broccoli und Tomaten sowie zur Patentfähigkeit von Stammzellen zeigen die ganze Brisanz dieses Rechtsgebietes.
Das vorliegende Werk behandelt ausführlich die Begriffsbestimmung, Ausnahmen und Spezialfälle bei biologischen Erfindungen, die Patentierungsvoraussetzungen, Schutzumfang und Anspruchsart sowie die Wirkung des Patents.

Structural alternations give rise to the question under what circumstances they can be novel and in which cases they are included under state of the art. But even if a substance is prior art, a new medical use of it can be patented, as such medical use patents are politically intended to promote medical research.
On the other hand, it is unclear how to deal with natural occurrences of a substance in terms of its accessibility an bioethics.
It must also be understood how different identifications of a substance and the resulting patents interrelate with each other, i.e. how their scopes of protections are defined. This is problematic especially because of the absolute substance of protection, which includes all conceivable uses and methods.
The past decisions of the ECJ as regards broccoli-and-tomato-patents, as well as embryonic stem cells have highlighted the importance of this field of law.
