englischThe maximum assignment period introduced by the recent reform of the Temporary Employment Act (AÜG), the possibility to deviate from it by collective bargaining agreements and the stipulated fiction of the employment relationship with the hirer in case of exceeding the maximum assignment period, provided that no declaration of adherence is submitted, raise several new questions of interpretation and application. This thesis critically examines the concept of the reform and primarily analyses the new regulations from a union, constitutional and collective bargaining law perspective. It also discusses several specific questions, such as the calculation of the maximum assignment period and the newly introduced declaration of adherence, and presents possible solutions for controversially discussed legal questions in the context of the new regulations.
