They are based on contributions to the conference entitled "Current questions related to notarial liability" held by the Rhenish Institute for Notarial Law. In his contribution, Prof. Dr. von Coelln considers notarial liability from the perspective of state liability. Dr. Andreas Remmert, a judge at the Federal Supreme Court, examines three current cases concerning notarial liability, while Prof. Dr. Prütting deals with causality and evidence in notarial liability law in the context of an actual court case. In this way, these contributions combine recent cases for those who apply the law with fundamental questions on notarial liability from both theory and practice..

Der Tagungsband „Aktuelle Fragen der Notarhaftung“ beleuchtet Haftungsfragen der Notare, die sich in jüngerer Zeit stellen und beruht auf den Beiträgen zu der gleichnamigen Tagung des Rheinischen Instituts für Notarrecht. Prof. Dr. von Coelln beleuchtet in seinem Beitrag die Notarhaftung aus staatshaftungsrechtlicher Perspektive. Dr. Andreas Remmert, RiBGH stellt drei aktuelle notarhaftungsspezifische Revisionsurteile des für die Notarhaftung zuständigen III. Zivilsenates des Bundesgerichtshofs dar. Prof. Dr. Hanns Prütting untersucht Kausalität und Beweisfragen im Recht der Notarhaftung auch anhand eines konkreten Falls.
Damit kombinieren die Beiträge gegenwärtige Fallgestaltungen für den Rechtsanwender mit grundlegenden Fragen zu der Notarhaftung aus Wissenschaft und Praxis.
