The book examines the constitutional framework an alternative conflict resolution judge must comply with and the procedural choices he or she can make. Based on extensive experience in handling alternative conflict resolution cases, the author develops answers that meet the requirements of the judiciary and those who practice law.

Das Güterichterverfahren (§ 278 Abs. 5 ZPO) ist eine Form gerichtlich gesteuerter alternativer Konfliktlösung. Über die Verweisungsnorm des § 202 SGG gilt es auch für den sozialgerichtlichen Prozess. Sein normatives Profil ist bislang weder im Grundsatz noch im Detail vollständig geklärt. Das hemmt die Bereitschaft der Praxis, das güterichterliche Verfahren zu nutzen.
