englischThe dissertation reappraises the problems of age differentiation highly topical in the German civil service law from union-juridical and constitutional-juridical perspective by case groups and discusses how offence affects the civil servants´ status relation. For many still unsettled legal issues logical and practical solutions are developed dogmatically. Legal and administrative age differentiations are treated in the status- and not status-related area of the official's relation. In detail it is about legal age limits for the civil servant´s appointment, his advancement and retirement, further about age-related differentiations in his place occupation procedure and about those dealing with working hours and holiday times as well as salary and pension expectancy. On account of the not seldom fiscal motivation of age-related differentiations the topical jurisdiction of the Federal Constitutional Court is also picked out as a central theme to the official's salary and is submitted to a critical assessment.
Das Werk arbeitet die im Beamtenrecht hoch aktuelle Problematik von Altersdifferenzierungen aus unions- und verfassungsrechtlicher Perspektive nach Fallgruppen auf und erörtert, wie sich Verstöße auf das beamtenrechtliche Sonderstatusverhältnis auswirken. Für viele noch ungeklärte Rechtsfragen werden dogmatisch konsequente und praxisgerechte Lösungen entwickelt. Behandelt werden gesetzliche und administrative Altersdifferenzierungen im status- und nicht-statusbezogenen Bereich des Beamtenverhältnisses. Im Einzelnen geht es um gesetzliche Altersgrenzen für die Einstellung, die Beförderung und den Ruhestand, um altersbezogene Differenzierungen im beamtenrechtlichen Stellenbesetzungsverfahren und solche bei den Arbeits- und Urlaubszeiten sowie der Besoldung und Versorgung. Aufgrund der nicht selten fiskalischen Motivation altersbezogener Differenzierungen wird auch die aktuelle Rechtsprechung des BVerfG zur Beamtenbesoldung thematisiert und einer kritischen Bewertung unterzogen.
