englischThe Federal Republic of Germany ratified the Convention on the Rights of Persons with Disabilities (CRPD) in 2009. The implementation of the right to inclusive education (article 24 CRPD) has become a highly controversial topic in the country. The author explains the legal impact of the convention in Germany. Are there elements of article 24 CRPD which are immediately and directly applicable? Which legislative steps does the implementation of an inclusive education system require?

As an example the author examines to what extent the legal situation in Bavaria is in compliance with article 24 CRPD. Furthermore he shows that the German courts don't sufficiently take the CRPD into consideration so far.
