englischThis volume documents the 12th Young Labour Law Scholars Conference, which took place from 20 to 22 July 2023 at the University of Bayreuth. The general topic of the Conference was "Labour Law as Concretised Constitutional Law?".
The relationship between the constitution and labour law has been the subject of debate for decades. On the one hand, labour law cannot be strictly separated from constitutional law. On the other hand, despite the primacy of the constitution, the scope for legislative decision-making and the autonomy of private and labour law must be preserved. The contributions in this volume address this tension from various perspectives.

Der Band dokumentiert die Referate der 12. Tagung Junge Arbeitsrechtswissenschaft (vormals Assistentinnen- und Assistententagung im Arbeitsrecht), die vom 20. bis 22. Juli 2023 an der Universität Bayreuth unter dem Generalthema „Arbeitsrecht als geronnenes Verfassungsrecht?“ stattfand.
Über das Verhältnis zwischen Verfassung und Arbeitsrecht wird bereits seit Jahrzehnten gestritten. Während sich das Arbeitsrecht nicht strikt vom Verfassungsrecht trennen lässt, müssen demgegenüber gesetzgeberische Entscheidungsspielräume und die Eigenständigkeit des Privat- und Arbeitsrechts, dem Vorrang der Verfassung zum Trotz erhalten bleiben. Diesem Spannungsverhältnis widmen sich die Beiträge aus verschiedentlicher Perspektive.
