englischBack in the early days of the Bundesliga (from 1956 to 1966), the overall annual income from TV broadcasting of Germany’s football league was the equivalent of 333,333 euros, whereas about 1.4 billion euros are currently generated each season through its audio-visual exploitation. Despite this development, neither national nor European statutory law currently provides for special protection of professional sports events, especially when it comes to them being televised. This analysis demonstrates that neither property rights nor copyright or moral rights are a suitable source of reference in this respect. But even the legal foundations applied by German courts, that is, domestic authority, laws of unfair competition and the law of tort, are only inadequate, temporary solutions. In consequence, it seems imperative to create special legal provisions for the protection and broadcasting of sports events, preferably on an EU level.
