englischThe common optional matrimonial property regime of Germany and France has since 1 May 2013 been available for married couples. Especially in times of rising mobility and migration it shall solve the problems that can be found in transnational relationships. This book examines how the common regime is built compared to the German and French law and how to handle those problems not regulated by the common rules. The main subjects are the regime’s foundation and its effects during marriage according to art. 1–7, 19–20. The explanations concentrate on the treaty’s termination, its application and the conditions for establishing and ending the matrimonial regime. Furthermore, the effects on the spouses’ property during marriage, namely the restriction on disposal and joint liability, are discussed.
