In contrast, gender research within the field of legal studies stresses the link between freedom and equality, and examines the real conditions in which equality of freedom can be implemented, which clearly reveals that legal regulation is often caught between emancipation and paternalism.
This book approaches this issue from both an interdisciplinary and an intra-disciplinary perspective by interweaving philosophical, sociological and political points of view with legal discourse in not only its analysis of basic terms and concepts, but also the way it addresses the question of autonomy and privacy, and that of autonomy in a democracy. The book analyses three particularly controversial topics in depth: procreation and surrogate motherhood, prostitution and pornography, and migration and solidarity.
Der juristische Mainstream denkt Autonomie im Wesentlichen als „Freiheit von …“ und versteht sie damit negativ. Die rechtswissenschaftliche Geschlechterforschung betont demgegenüber den Zusammenhang von Freiheit und Gleichheit und fragt nach den realen Anwendungsbedingungen gleicher Freiheit. Dann zeigt sich besonders deutlich, dass rechtliche Regulierung häufig in einem Spannungsverhältnis zwischen Emanzipation und Bevormundung steht.
Der Sammelband nähert sich dem inter- und intradisziplinär. Philosophische, soziologische und politikwissenschaftliche Perspektiven werden mit dem juristischen Diskurs verwoben. Das gilt für die Auseinandersetzung mit den Grundbegriffen, für die Frage nach Autonomie und Privatheit und nach Autonomie in der Demokratie. Drei besonders umstrittene Themenfelder werden vertieft analysiert: Reproduktion und Leihmutterschaft, Prostitution und Pornografie sowie prekäre Arbeit, Migration und Solidarität.
