englischBased on a formal conception of autonomy, structures and objectively valid core contents of human rights are elaborated. The conception of autonomy as a balancing of normative arguments and its connection with the principle theory of law is presented. On this basis, the need to recognize human rights is justified and their content is explained. The transformation of human rights into constitutional rights is analysed and the conception of human rights as transnational constitutional law is outlined. The aim of the book is to explore the possibility of objective knowledge in the field of human rights. The book continues a series of works that reconstruct law on the basis of the idea of autonomy.

»[...] stellt einen überaus interessanten rechtstheoretischen Beitrag zur autonomen Normbegründung im Bereich der Menschenrechte dar.«
Verena-Maria Niedrist, NLMR 2/2023
