englischThe ruling by the Ninth Civil Chamber of the German Supreme Court on stipulations on bank charges in banks’ general terms and conditions has been one of the most controversial legal issues for some time, and not only among experts in this field. Persistent historically low interest rates have increased banks’ economic need to generate additional revenue from bank charges. This has resulted in numerous civil lawsuits on the effectiveness of contractual stipulations on such charges, which are being used in increasingly new forms. This book summarises the significant principles of the ruling by the Ninth Civil Chamber of the German Supreme Court on such stipulations in banks’ general terms and conditions on loan agreements and transactions, and examines the protective concept of the contractual legal regulations on bank charges, which lies at the heart of this issue.
