englischTerminal medical treatment of dementia patients raises many legal problems. In particular, in the case of a current natural will that contradicts the living will, a conflict of wills may arise that must be resolved. This issue is dealt with in detail in the study. The basis of the study is the revocation of the living will standardized in Section 1827 (1) sentence 3 of the German Civil Code (BGB), for which the sufficiently clearly expressed natural will may be sufficient. Within the framework of the study, various manifestations of the natural will are examined with regard to their legally relevant will content and practical procedural proposals for solutions are developed.
Die terminale medizinische Behandlung dementiell Erkrankter wirft viele Rechtsprobleme auf. Insbesondere im Falle eines aktuellen natürlichen, der Patientenverfügung widersprechenden Willens kann sich ein Willenskonflikt einstellen, den es zu lösen gilt. Mit dieser Thematik wird sich in der Untersuchung eingehend befasst. Grundlage der Untersuchung stellt der in § 1827 Abs. 1 S. 3 BGB normierte Widerruf der Patientenverfügung dar, für welchen der hinreichend deutlich zum Ausdruck kommende natürliche Wille ausreichen kann. Im Rahmen der Untersuchung werden verschiedene Erscheinungsformen des natürlichen Willens auf ihren rechtlich relevanten Willensgehalt überprüft und praxistaugliche verfahrensrechtliche Lösungsvorschläge erarbeitet.
