englischAlthough Turkish civil procedural law has many similarities with German civil procedural law, they differ in the field of evidence law and documents. In Turkey, much more emphasis is placed on written evidence. The Turkish Code of Civil Procedure stipulates that certain legal transactions as well as objections arising from legal transactions, which are raised against a claim founded on a document, can only be proven by presenting a document. Furthermore, the Turkish Code of Civil Procedure provides for a presumption that the contents of a document reflect reality. This work aims to explain how these systems work and the reasons for the differences. This serves to prevent losses of rights resulting from a lack of information and enables the development of suggestions for improvement.
