This work seeks to answer the question whether this is guaranteed regarding biogas plants as one of the most important sources of an "intelligent" energy mix.
Therefore, the compatibility of the EEG with the state aid law of the European Union is examined. On the national level administrative control instruments and licensing conditions are critically analysed. The establishment and the operation of the energy-crops are validated as well as the cultivation.
In summary, this work deals with a stock-taking of the laws on biogas-plants with regard to legal problems which are typical for the practise. Besides that, new – being in accordance to the concept of sustainable development – dogmatic solution attempts are presented along with suggestions with regard to a desirable legal development in a well-organised law.
Eine erfolgreiche Energiewende erfordert, dass sie auch unter rechtlichen Gesichtspunkten nachhaltig verläuft. Die Arbeit befasst sich mit der Beantwortung der Frage, ob dies in Bezug auf Biogasanlagen als eine der wichtigsten Quellen eines „intelligenten“ Energiemixes gewährleistet ist.
Hierzu werden insbesondere die Vereinbarkeit des EEG mit dem Beihilfenrecht der Europäischen Union geprüft sowie auf nationaler Ebene behördliche Steuerungsinstrumente und Genehmigungsvoraussetzungen kritisch untersucht. Die Errichtung und der Betrieb einerseits und der Energiepflanzenanbau andererseits werden dazu getrennt geprüft.
Zusammenfassend behandelt das Werk neben einer Bestandsaufnahme zum Recht der Biogasanlagen bezüglich praxistypischer Rechtsprobleme auch neue – einer nachhaltigen Entwicklung entsprechende – dogmatische Lösungsansätze und präsentiert Denkanstöße bezüglich einer wünschenswerten Rechtsentwicklung in einem wohlgeordneten Recht.
