englischThe study offers a comprehensive examination of the law applicable to blockchain networks and crypto assets. The objective is to find out whether private international law, which traditionally searches for the 'seat' of a legal relationship, is able to capture these inherently transnational phenomena. The focus is on the one hand on the legal relationships between the participants of blockchain networks, and on the other hand on the legal transactions under the law of obligations and in rem in connection with the issuance and trading of crypto assets. The study also considers the recent reform of German (international) securities law by the eWpG. Finally, it develops a proposal for a future blockchain-specific conflict-of-laws rule.
