englischThe dissertation contributes to a better understanding of „cyber-grooming“ and section 176(4) No 3 German Criminal Code: Its initial, empirical part indicates that - contrary to popular opinion – youngsters and adolescents appear as offenders in a considerable number of cases of „cyber-grooming“. The following parts take a critical look into the legal interest which is protected by section 176(4) No 3 German Criminal Code according to the prevailing opinion and into the weaknesses of the current wording of the criminal provision. Next, the dissertation examines the constitutionality of the criminal provision. This shows that the scope of section 176(4) No 3 German Criminal Code conflicts with constitutional law as it is formulated too extensively. The dissertation concludes with a reform proposal which eliminates the detected weaknesses of the provision.
