englischOn 1 May 2004, eight Central and Eastern European states joined the European Union. The dissertation focuses on the transitional provisions, the 2-3-2 formula which have been agreed regarding the free movement of labour and the freedom to provide services. The author illustrates the transitional regime as well as its national implementation. The main focus of the work lies on the legality of transitional arrangements. The work deals with the justification of the violation of fundamental freedoms by the implementation of transitional periods. Subsequently, the proportionality in the application of the transitional arrangements is examined. In the framework of the jurisprudential analysis, the author uses Germany and Poland as examples to draw a comparison between the expected migration potential and the actual impacts on the labour markets of the old Member States. Therefore, the work is at the same time a contribution to the evaluation of the eastern enlargement of the European Union.
