englischThis thesis examines, as a monograph, the relationship between arbitration and the law on general terms and conditions in business transactions. It focuses, in particular, on two interconnected aspects of the problem: Firstly, it discusses the role which the law on general terms and conditions plays in national and international arbitration when the seat of arbitration is in Germany or Greece. The author questions the applicability of the law in question in the context of arbitration, as well as whether the parties are allowed to agree to its exemption. Secondly, the work identifies and examines the issues surrounding the agreement of all kinds of arbitration clauses as GT&C in business contracts, under the scope of application of German and Greek law. The author makes an important contribution to the study of the content review of arbitration clauses by suggesting a new approach regarding their eligibility for submission to such a review.
