englischInitially, the so-called Transnational Human Rights Litigation was a mere US-American legal phenomenon. The Alien Tort Statute served for several years as a statutory instrument for gaining jurisdiction over serious violations of International Law committed by individuals or multinational companies. The author examines this form of strategic litigation from a US and a European perspective. His analysis aims at answering the question whether these transnational human right claims can be an adequate approach to implement global legal standards.
