As a result, antitrust violations are sanctioned at the national level in the context of a fine procedure, as governed by the provisions of criminal procedure law (OWiG, StPO). The application of criminal procedure law is linked to the validity of criminal procedure maxims and the involvement of the public prosecutor. The purpose of this thesis is to examine the question of the extent to which German cartel fine proceedings should be reformed and how procedural delays can be prevented while simultaneously promoting truth. This raises the question of whether a reformed cartel fine procedure can serve as a model for modern economic criminal procedures.
Kartellrechtsverstöße werden in Deutschland überwiegend als Ordnungswidrigkeiten sanktioniert. Dies hat zur Folge, dass Kartellrechtsverstöße auf nationaler Ebene im Rahmen eines Bußgeldverfahrens sanktioniert werden, das sich nach strafverfahrensrechtlichen Vorschriften (OWiG, StPO) richtet. Die Anwendung strafverfahrensrechtlicher Vorschriften ist mit der Geltung strafprozessualer Prozessmaximen verbunden und der Einschaltung der Staatsanwaltschaft als Verfolgungsorgan. Gegenstand der Arbeit ist einerseits die Frage, inwieweit das deutsche Kartellbußgeldverfahren Reformbedarf aufweist und andererseits, wie Verfahrensverzögerungen verhindert und die Wahrheitserforschung gleichzeitig gefördert werden kann. Im Anschluss stellt sich die Frage, ob ein reformiertes Kartellbußgeldverfahren Vorbildfunktion für ein modernes Wirtschaftsstrafverfahren haben kann.
