englischThis dissertation examines the tension between European State Aid Law and the promotion of renewable energy in Germany. Against the background of the judgement of the European Court of Justice regarding the EEG 2012 (Case C-405/16 P) the author critically analyses the scope of the notion of aid regarding the german system for the promotion of renewable energy.

Furthermore the often criticized influence of the European Commission on the member states’ politics by means of State Aid Law is examined. In the course of this examination the author does not only take a closer look at the Commission’s so-called guideline policy against the background of the provisions laid down in Art. 290, 291 TFEU. He does also map out a fundamental concept of State Aid Law as legal matter between negative and positive integration.
