Specifically, many question whether a parallel existence of the statutory and private health insurances makes sense from a socio political and competition political perspective.
Constitutional debates about the merger of statutory and private health insurance almost inevitably lead to an exploration of the specifics and individuality of each financing law, which is the core issue for any systems integration.
This paper first analyses the financing laws of both the statutory and private health insurance, then takes the reform discussions into consideration and concludes with a constitutional debate. How to deal with aging provisions and persons eligible for aid within an integrated system represents the key challenge.
Hinter dem Schlagwort „Finanzierungsrecht der Krankenversicherungen“ steht die Diskussion um das duale Krankenversicherungssystem. Es geht hierbei um die viel und kontrovers diskutierte Frage, ob es aus sozial- und wettbewerbspolitischer Sicht sinnvoll ist, die Gesetzliche und Private Krankenversicherung nebeneinander bestehen zu lassen.
Reformdiskussionen zu einer Zusammenführung von Privater und Gesetzlicher Krankenversicherung führen zwangsläufig zu einer Auseinandersetzung mit der unterschiedlichen Ausgestaltung des jeweiligen Finanzierungsrechts, welche ein Kernproblem der Systemintegration darstellt.
Die Arbeit analysiert zunächst das Finanzierungsrecht der Gesetzlichen und Privaten Krankenversicherung, thematisiert anschließend verschiedene Reformdiskussionen und schließt mit einer verfassungsrechtlichen Diskussion. Zentrale Fragestellung ist dabei der Umgang mit Altersrückstellungen und Beihilfeberechtigten in einem integrierten System.
