englischAs a result of the recent case law of the European Court of Human Rights and some decisions of administrative courts in Germany, strike by civil servants came to the fore of German jurisprudence. So far, civil servants who are employed at a private undertaking have received little attention. However, collective agreements are of considerable practical relevance for these persons. The book is devoted to this particular group and illustrates that the restrictions on collective bargaining and the right to strike which apply to civil servants can no longer be justified in case of employment in the private sector. Based on existing law, a legal framework for collective bargaining and collective action which allows for enacting normative collective regulations for civil servants is being developed. This research is carried out using the example of the more than 80,000 civil servants who are being employed at the undertakings which have succeeded the state-owned enterprise Deutsche Bundespost and the special provisions of the Postpersonalrechtsgesetz.
