englischThis thesis develops a conflict of laws concept for the cross-border activities of collecting societies. Despite the deliberate promotion of the Europeanisation of collecting societies and the increasing internationalisation of their activities, this issue has so far remained unaddressed. The work first examines the problem from the perspective of private international law. In a second part, it analyses the characteristics of collecting societies in the EU internal market. The conflict-of-law rules have been developed on the basis of a function-based approach and reflect the systematic interdependence of different legal regimes controlling the activities of collecting societies. Against this background, the developed conflict-of-law rules are not only applicable in a German or European context, but can also be generalised. Where collecting society laws perform similar functions, the same principles can be directly applied.
