The background for the concrete version of the german Civil Law Code are doctrines of the Pandectistic Science and the Historical School of Law, who both are explainable out of Immanuel Kant´s Philosophy, not out of the Roman Law, which they invoked.
The book analyses the german Civil Code just as well as the main writings of the Pandectistic Science and proves them on the ancient, medieval and the modern Roman-Common Law. In the end it makes a proposal for an new systematization of the doctrine of objects in Civil Law.
Das Bürgerliche Gesetzbuch vertritt vordergründig einen engen Sachbegriff, der allerdings wenig Ansatz für eine plausible Objektlehre bietet, wie sie einer Zivilrechtskodifikation an sich zu entnehmen sein müsste. Missverständliche Formulierungen im Normtext selbst verschärfen die Problematik.
Hintergrund der konkreten Fassung des BGB sind Lehrmeinungen der Pandektenwissenschaft und der Historischen Rechtsschule, die beide allein aus zeitgenössischem Bezug etwa zur Philosophie Immanuel Kants erklärbar sind, nicht jedoch aus den Traditionen des römischen Rechts, auf das sie sich berufen.
