englischThe jurisprudence as well as the medical research sector have repeatedly issued calls for a reform of the medically and socially out-dated ESchG. The ESchG, which decisively influences the laws and regulations of reproductive medicine until today, has remained almost unmodified since it entered into force in 1991. The law has not withstood the advances in modern reproductive medicine nor the changes to social values. It is therefore time for the legislator to become aware of his legislative responsibility and to create a modern reproductive medicine law. The treatise shows the legislative need for action in the field of reproductive medicine and proposes solutions for this, whereby the provisions proposed in the so-called “Augsburg-Münchner Entwurf für ein Fortpflanzungsmedizingesetz (AME-FMedG)”, the Augsburg-Munich Draft for a Reproductive Medicine Law, are included and critically questioned.
