englischThis book concentrates on the emergence of legal genres within Islamic jurisprudence. It identifies reformist tendencies in the development of legal advice, which either relate to practical life or reveal disaffection with religion. This study addresses questions of everyday life that are relevant to legal issues, divides them into systematic topics and denotes them with aesthetically appealing terms, such as female-related jurisprudence (fiqh an-nisāʾ). This raises the question of how legal scholars fill quintessential, general legal topics with practical legislative requirements, literary typologies and legal content in order to classify them as specific legal categories. In this context, the book has two objectives: On the one hand, it discusses the semantic development of fiqh an-nisāʾ and its change of meaning with regard to quintessential reference texts, as well as revising the characteristics of the content of the entire legal system. On the other hand, by putting the systematic development of this legal genre in its judicial context, this study illustrates key aspects of its relevance for the discussion of legal typology within the framework of Islamic jurisprudence.
