englischWhy do we need specific regulations for data protection in employment contexts? To answer this fundamental question the author outlines the status quo of German employee data protection. Hereafter, he analyses traditional as well as modern explanations for data protection in general.

In particular, data protection through private autonomy, the Anglo-American right to privacy and arguments of the economic analysis of law are transferred to employee data protection – only if special constellations are found, special regulations are needed. Based on the general results, the most discussed issues in employee data protection are discussed; they become even more pressing in consideration of the new General Data Protection Regulation: employees’ consent, video observation or the personal scope of employee data protection.
