englischArtificial Intelligence, Machine Learning and Big Data pose a challenge to the European data protection law. Due to the technology-neutral design of the General Data Protection Regulation, the requirements for these kinds of applications are unclear. The author therefore examines the compatibility of data science with data protection law using the example of employee data protection. Additionally, a possible legislative need for action on European level is explored as well as the extent to which the member states still have room for maneuver, at least in the area of employee data protection.
Künstliche Intelligenz, Maschinelles Lernen und Big Data stellen das europäische Datenschutzrecht vor Herausforderungen. Aufgrund ihrer technologieneutralen Ausgestaltung wird dabei nicht auf den ersten Blick deutlich, welche Vorgaben die Datenschutz-Grundverordnung für entsprechende Anwendungen beinhaltet. Vor diesem Hintergrund untersucht der Autor die Vereinbarkeit solcher „Data Science“-Anwendungen mit dem Datenschutzrecht am Beispiel des Beschäftigungskontexts. Neben der Frage nach Handlungsbedarf für den europäischen Gesetzgeber wird in diesem Zusammenhang auch beleuchtet, inwieweit für die Mitgliedsstaaten zumindest im Beschäftigtendatenschutz noch Regelungsspielraum besteht.
