The events of 9/11 pose this question to all states. While the competence to shoot down a hijacked plane is legally and socially undisputed in the U.S., the decision of the German Bundesverfassungsgericht, about the newly legislated statute in regard to hijacked planes fueled a bitter discussion about the core values of German constitutional law.

How do the different approaches reflect the particular constitution, their interpretation and understanding? Which core values are represented in the divergent decisions? This dissertation highlights the different interpretations of sovereignty represented by national law, showing that hijacked airplanes present a threat to the state and it’s sovereignty as a whole, touching the core values of a national society.
