Der schuldrechtliche Vertrag sichert Freiheit und Demokratie. Doch bei sozialen Nutzungsverträgen lässt er Zweck und Dauer außer Acht. Stattdessen herrschen dort weiter Vorstellungen einer Sklavengesellschaft von Unterordnung, Fremdbestimmung und Abhängigkeit, wo die Nutzung von Arbeitsplätzen, Wohnungen und Verbraucherkrediten rechtlich zu beurteilen ist. Dabei gab und gibt es eine Alternative, das Mietvertragsmodell der locatio conductio. Anstelle von exklusivem und punktuellem Erwerb von Eigentum im kaufrechtlichen Denken stellt es den dauerhaften Nutzen in den Mittelpunkt. Dies führt zu einem „anderen“ sozial gerechteren Vertrag, der den Verhältnissen heute besser gerecht wird.
