englischFighting for a collective labour agreement continues to be the only lawful mode of collective industrial action under German Law. Scholars and Courts traditionally considered the freedom of collective action to be rooted in the freedom of collective bargaining in Art. 9 Sec. 3 GG. However, this interpretation and the limitations that come with it are by no means evident, as this dissertation shows. In addition, it asks how such a limited freedom of collective action may be considered to be in conflict with supranational law (Art. 6 Nr. 4 ESC, Art. 11 ECHR und Art. 28 EU-CFR). As a result, the German legal framework of collective industrial action needs to be re-assessed in the light of a European Economy and Labourmarket increasingly driven by Digitalisation, a Platform Economy and Coworking.
