englischThis study discusses the historical and (power-) political backgrounds as well as the legally and theologically questionable justification of the historically unique constitutional amendment with which the Pakistani parliament excommunicated Ahmadi Muslims from Islam—a decision wholly at odds with their religious self-understanding—in 1974 by virtue of their alleged office. As an assessment criterion, the study adopts the respective concept of religious freedom in the three authoritative legal orders—Islamic legal sources, Pakistani constitutional law and public international law— as its basis and deals in detail with the question of the (in)compatibility of the action of amending constitutional legislation with the three authoritative legal orders, from a formal and authority-oriented perspective as well as from a substantive and material point of view.
