englischThe regulation and implementation of occupational health and safety standards is one of the core tasks of the welfare state. However, the Europeanisation and globalisation of society and law have led to a transformation of statehood. Social norm building and enforcement are often assigned by transnational private or hybrid (private-state) actor constellations instead of the states themselves. In Europe, and especially in the area of occupational safety and health, so-called "transnational social dialogues" are becoming increasingly important. By means of a comprehensive document analysis, various expert interviews, three case studies and juridical diffusion analyses, the author examines transnational social dialogues norm building and norm enforcing results with regard to their contributions to the European occupational health and safety regulation, comparing them with the requirements of the European welfare state standard.
Arbeitsschutzrechtliche Normenbildung und Normenumsetzung zählen zu den Kernaufgaben des Sozialstaats. Im Zuge der Europäisierung und Globalisierung von Gesellschaft und Recht zeichnet sich auch auf dem Gebiet des Arbeitsschutzrechts ein Wandel der Staatlichkeit ab. Aufgaben des Nationalstaates werden vielfach nicht mehr nur durch den Nationalstaat, sondern durch transnationale private und hybride (staatlich-private) Akteurskonstellationen wahrgenommen. In Europa und dort insbesondere im Bereich des Arbeitsschutzrechts gewinnen sog. „transnationale Soziale Dialoge“ immer mehr an Bedeutung. Dessen gemeinsame normbildenden und normdurchsetzende Ergebnisse wurden anhand einer 3.000 Dokumente umfassenden Dokumentenanalyse, diversen Experteninterviews, drei Fallstudien und rechtswissenschaftlicher Diffusionsanalysen im Hinblick auf deren Beiträge zum europäischen Arbeitsschutzrecht untersucht und mit den Anforderungen des europäischen Sozialstaatsmaßstabes verglichen.
