englischThe download of digital content has established itself as a form of distribution and raises questions in contract, competition and copyright law. Using the example of the e-book, the contract for the supply of digital content between vendor and customer are examined in detail. The main focus is on the typological classification of the contract. For this purpose, the object of the contract and the interaction of the fields of law are elaborated. This is the background for the subsequent question of the contract design. The permissibility of restrictions is examined on the basis of selected GTC clauses and technical protection measures. In particular the discussion about the resale of used e-books will be solved.
Der Download von digitalen Inhalten hat sich als Bezugsform etabliert und wirft im Vertrags-, Wettbewerbs- und Urheberrecht Fragen auf. Am Beispiel des E-Books wird das Rechtsverhältnis zwischen Anbieter und Kunde beim digitalen Erwerb eingehend untersucht.
Im Vordergrund steht die typologische Zuordnung des Vertrags. Zu diesem Zweck werden der Vertragsgegenstand und das Zusammenspiel der Rechtsgebiete herausgearbeitet. Hierauf baut die Folgefrage nach den vertraglichen Gestaltungsmöglichkeiten auf. Anhand ausgewählter AGB-Klauseln und technischer Schutzmaßnahmen wird die Zulässigkeit von Einschränkungen untersucht. Dabei wird insbesondere die Diskussion über den Weiterverkauf von gebrauchten E-Books einer Lösung zugeführt.
