englischThe thesis assesses the dilemma financial institutes face in the course of having to comply with supervisory law and employment case law. The solution suggested, is to reduce prerequisites for provisions in pre-formulated employment agreements.

In the first part, the author lists the provisions regarding remuneration that are addressed to financial institutes. It is shown, that the primary regulatory demand is to be found in longterm incentives for employees.

In the second part, the author summarizes the strict case law regarding pre-formulated claw-back-clauses in employment contracts andexamines their ability to promote sustainable decisions.
