englischCompensation claims due to excessively long court proceedings according to §§ 198 ff. of the Gerichstverfassungsgesetz (Germany’s Courts Constitution Act) have closed a loophole in state liability law. On the one hand, this work examines the legislative structure in this respect from the point of view of fair procedures, legal certainty and justice. The timing of the notification of a delay in court proceedings and the amount of compensation for material disadvantages are particularly problematic. On the other hand, the author also examines the application of a claim by the compensation courts. Here, he focuses on the interpretation of appropriacy criteria, the question of considering each case individually and the amount of compensation for immaterial disadvantages.
