englischThis book examines how the right to a fair hearing of foreign litigants can be preserved in the face of the progressive digitalisation of national judicial systems. While the classical approach of international civil procedure law relies primarily on the written form, we find an advanced digitalisation in domestic communication. In order to guarantee the principle of the protection of the right to be heard also in cross-border judicial proceedings, the standards of digital communication must also be realised for the cooperation between states and their central authorities and courts. Fundamental procedural guarantees must not be violated even with pragmatic access to technology. The perspective chosen by the authors is not limited to the European Judicial Area.
