englischThe thesis deals with the criminal law on competition in particular from a dogmatic and legal-political point of view. After a closer contouring of the object of protection "competition", for which also economic findings are used, the question is pursued whether a protection of competition by criminal law is legitimate. The clarification of the concept of competition also has consequences for the teleological interpretation of the offenses of the 26th section of the German Criminal Code, in particular, as is shown in the work on the basis of a large number of elements of the offense. The work also contains a number of legal policy recommendations, which primarily concern the question of criminalizing conduct such as hardcore cartels.
