englischIn the field of law enforcement, insolvency law and criminal law collide in a problematic way. Building on the purpose of the execution of sentences, this dissertation illuminates the areas of conflict based on the diverging interests of the legal fields. In this context, a detailed examination is made of the question of whether a convicted person can be ordered to pay the fine again after contesting under insolvency law a fine paid before the opening of insolvency proceedings in the light of the prohibition of multiple punishments in Article 103 (3) GG. In addition, the substitute custodial sentence as a surrogate penalty for a fine that is irrecoverable during the ongoing insolvency proceedings is critically questioned.
