englischThe implementation of the European Services Directive revealed the necessity of significant adjustment not only in German administrative law, but also demonstrated the difficulties other EU-member states are facing. This doctoral thesis deals with topics related to the implementation of the Services Directive in one of Germany’s most important trading partners among other Eastern European countries: Poland. It demonstrates which obstacles should be overcome for the former socialist country to take part of the European services market as an equal member of the European Union under the Services Directive.

 

Following the historical depiction of the Polish services industry as well as the description of the legal framework, the thesis focuses on the implementation of substantive movement of services. The author explores the institutional and legal procedural requirements aimed at improvement, regulation and administrative simplification in the field of Polish service activities, which corresponds to the dual objective of the Directive. It is illustrated how various legal traditions in different EU Member States can lead to divergencies in legal problems and solution models. Particular emphasis of the dissertation is placed on the creation of the procedural core of the Services Directive – the single point of contact – which is exercised in Poland purely virtually as a website.
