englischHenrique Neves investigates the relation between legal normativity and legal facticity on the basis of Hans Kelsen's legal positivism and Robert Alexy's non-positivism. On the basis of the parallelism thesis, the author explains how the legal phenomenon is constituted by thoroughly analyzing the mode of constitution and existence of legal norms and legal facts. Thus, the author argues for the importance of a concept of legal fact in legal theory and for its parallel relation with the concept of legal norm. The fact that legal facts are both a condition and a fulfillment of legal validity is an important result of the investigation.
