englischWhen the Treaty of Lisbon came into effect in 2009, the EU’s constitutional framework on trade policy was fundamentally remodelled. The profound effects of these changes can now be observed in both legal practice and in the composition of the EU’s policy on trade, which are also the focus of legal action in the German Federal Constitutional Court. This anthology is devoted to these developments. The essays it contains focus on constitutional considerations related to the federal and cooperative implementation of the EU’s common trade policy by its member states as well as on the ongoing debate in the fields of law and political science about the problem of who is democratically entitled to trade within the EU according to the rule of law.

Mit dem Inkrafttreten des Vertrags von Lissabon vor sechs Jahren wurde der unionsverfassungsrechtliche Rahmen der gemeinsamen Handelspolitik grundlegend neu gestaltet. Mittlerweile zeigen sich die teils erheblichen Auswirkungen dieser Änderungen in der Rechtspraxis wie in der Gestaltung der Handelspolitik, die auch Gegenstand von Verfahren vor dem Bundesverfassungsgericht sind. Der Sammelband widmet sich diesen Entwicklungen. Der Schwerpunkt der Abhandlungen liegt auf den verfassungsrechtlichen Gesichtspunkten der föderativ-kooperativen Ausübung der gemeinsamen Handelspolitik durch die EU und die Mitgliedstaaten sowie den rechts- und politikwissenschaftlich fortwährend diskutierten Problemen demokratischer und rechtsstaatlicher Ansprüche an unionales Handeln.
