englischWeb 2.0 has revolutionised Internet usage. However, the achievements of new media have facilitated new ways of violating rights.

This treatise analyses the liability of providers when it comes to the various ways in which using the Internet can lead to violation of personality rights: any statements in fora, any Google autocomplete suggestions and any posts stored in online archives that violate personality rights.

This provider liability is not dealt with consistently in law. Using non-transparent previous individual cases and the so-called ‘Störerhaftung’ (breach of duty of care), this study attempts to ensure the protection of third parties’ personality rights. It places an emphasis on providing a consistent basis of liability for host providers through universal liability requirements, especially similar audit requirements.
