englischThis work reveals the juridical responsibility for the behaviour of medical students in their practical year concerning criminal and civil law. It is considerd as a practically relevant guide for the students themselves, their mentoring specialists and the teaching hospital. Starting from the principles of liability concerning medical work-sharing the author develops a special standard of liability for the medical students in their practical year. Following this, the requirements of an sustaining individual support and surveillance through the mentoring specialists of the teaching hospital is focussed, also in the case of a body of acting persons. Finally liability claims of the civil law and claims to transference of the student against the teaching hospital are discussed.

Das Werk zeigt die strafrechtliche und zivilrechtliche Verantwortlichkeit für das Handeln eines Arztes im Praktischen Jahr auf. Es versteht sich als einen praxisnahen Wegweiser für den Studenten selbst, die ihn betreuenden Fachärzte und das Universitätsklinikum. Ausgehend von den Grundsätzen der Haftung bei arbeitsteiligem medizinischem Arbeiten wird ein Haftungsmaßstab des Arztes im Praktischen Jahr entsprechend seinen Fähigkeiten entwickelt. Ein weiterer Schwerpunkt liegt in den Anforderungen an eine ausreichende individuelle Betreuung und Überwachung durch die zugeordneten Fachärzte des Universitätsklinikums auch im Falle von Personenmehrheit. Schließlich werden zivilrechtliche Haftungsansprüche sowie Übernahmeansprüche des Studenten gegen das Klinikum diskutiert.
