Another topic of the conference was the acceptance of the primacy of Union law by the national supreme courts and the question of whether and how a convergence of the different points of view would be possible here.
Das Staatsrecht muss die Veränderungen in der Struktur der gesellschaftlichen Kommunikation im Zuge der digitalen Revolution ebenso in das Gebäude des Staatsrechts und der allgemeinen Staatslehre integrieren, wie die zunehmende Enthumanisierung der Entscheidungen durch Algorithmen und künstlichen Intelligenz sowohl im öffentlich-rechtlichen als auch im privatrechtlichen Bereich. Die Diskussion über diese vielschichtigen und komplizierten Fragen wurden auf der Tagung der Societas Iuris Publici Europaei (SIPE) von Fachleuten aus Theorie und Praxis lebhaft diskutiert. Ein weiteres Thema der Tagung war die Akzeptanz des Vorrangs des Unionsrechts durch die nationalen Höchstgerichte und die Frage, ob und wie hier eine Konvergenz der unterschiedlichen Standpunkte möglich wäre.
