englischThe work considers the implied declaration of intent in the area of conflict between the expression of legal self-determination and pure equity. By means of case groups, the subjective and objective requirements of conclusive declarations of intent as required by case law are worked out and classified dogmatically. Contrary to an increasing objectification of legal transaction doctrine, the author presupposes the will or the consciousness of explanation as the reason for a primary obligation. Furthermore, the author formulates minimum requirements for the determination of the legal consequences in order to counteract the increasing dissolution of the boundary between explanatory and supplementary interpretation.
